Declaration of Fundamental Rights

Preamble

I, King Haakon VIII, King of Cotland, Defender of the Realm, Protector of the Faiths, Guardian of the Weak, Supreme Warlord, in session in Parliament as lawfully summed and assembled in the the City of Eeobroht, on this day, Monday, the Twentieth day of October, in the Year 1051 (AD 2008), do declare the following to be the Fundamental Rights for any and all Citizens of the Realm of Cotland, and Protected under the Monarch's Guarantee:


On Individual Rights

  • 1.) That a Citizen of the Realm shall be considered as any Person, regardless of Gender, Race or Religion, that has been born within the Borders of the Realm or who has Resided within the Borders of the Realm for no less than ten years and sworn allegiance to the Monarch and the Realm.
  • 2.) That any and all Citizens of the Realm shall have the Fundamental Right to Speak Freely about any Subject, without fear of Penalty or Death.
  • 3.) That any and all Citizens of the Realm shall have the Fundamental Right to assemble in a Congregation of any Size in any Public Area of the My Realm, without fear of Penalty or Death.
  • 4.) That any and all Citizens of the Realm shall have the Fundamental Right to Believe in and Worship any Diety they deem to be True and Just, without fear of Penalty or Death.
  • 5.) That any and all Citizens of the Realm shall have the Fundamental Right to live in Peace and Prosperity under the King's Peace, without fear of Penalty or Death.
  • 6.) That any and all Citizens of the Realm that are brought before the Magistrates shall have the Fundamental Right to have their case tried by a Jury of his Peers, if they so choose.
  • 7.) That any and all Citizens of the Realm shall have the Fundamental Right to have their Appeals subject to a Trial by a Jury of peers, and shall be heard by a Magistrate to be chosen at random.
  • 8.) That no one under the King's Peace shall be held for longer than is reasonably necessary until being presented before a Magistrate for trial, nor being informed of the reason for their being held.
  • 9.) That the Common Law shall act only to levy proper recompense for assault against a Person or his Property, and otherwise to leave each Citizen to conduct his own affairs in peace.
  • 10.) That any and all Citizens of the Realm shall have the Fundamental Right to be free from undue detention and restriction from the Authorities of the Crown.


On Legislature and Administration of the Realm

  • 11.) That no Acts of Legislation passed in My Realm shall be applicable to Actions taken before the Date of the Act's Signing into Law. No Law shall be applied retroactively.
  • 12.) That the Citizens of Cotland shall have the Fundamental Right to Political Representation in the form of the Parliament of the Realm in the City of Eeobroht, which shall have the Sole Power to formulate Acts of Legislation.
  • 13.) The Parliament shall be made up of Representatives from all the Counties and Duchies, to be elected by all citizens of Cotland over the age of 18 who are not debtors, felons or of unsound mind, not less than once every four years. The Representatives of Parliament can be elected for a total of five periods, of which a maximum of three four-year periods can be served simultaneously.
  • 14.) For legislation to be entered into the Statute book as Law it must have the majority assent of the Parliament and the signature of the Monarch.
  • 15.) That there shall be full seperation between Religion and Affairs of State.


On the Rights of the Monarch

  • 16.) That the Monarch shall defer the appointment of the Magistrates of any given Place to the Alderman of that Place.
  • 17.) That the Armed Forces of the Realm shall not be employed against the People of Cotland under any Condition, except during Times of Declared National Emergency or War as Duly Declared by the Monarch and affirmed through Act of Legislature by the Parliament.
  • 18.) That the Monarch shall transfer the Power to decide Death of the Population to the Magistrates, save for the Royal Veto to commute Death Sentences as issued by the Magistrates.
  • 19.) That the Monarch shall have the right to give Royal Clemency to Citizens sentenced by the Magistrates as He sees fit.
  • 20.) That the Monarch shall retain the Right to Raise and Decrease the troops in the Armed Forces of the Realm, and Declare War and Peace on the behalf of his Realm, with the affirmation of the Parliament.


Closing

As the Monarch of Cotland, I declare by my Natural Right to rule that these articles are the Fundamental Rights of all Citizens of Cotland, and further declare that I intend that, as Natural and Timeless Rights, they endure as principles of my Realm for all perpetuity. I further declare that the succession to the throne of the Realm shall be dependent upon the successor's signing of this document, and that if I ever were to breach the provisions here that I renounce my and my House's Claim to the Throne of the Realm of Cotland for all eternity.
